4. Communications & Marketing Consent

4.1 General

By voluntarily providing your contact information through any University form, you may consent through checking the consent checkbox to receive communications from Nexford University through one or more of the channels described in this section. Your consent to receive marketing communications is never a condition of applying to, enrolling in, or purchasing any program or service from Nexford University.

Your contact information will not be shared with third parties or affiliates for their own marketing or promotional purposes. This information is used solely for communications from the University, consistent with our Privacy Policy.

Types of Messages

By providing your mobile phone number and checking the consent checkbox through any University form, you agree to receive SMS text messages from Nexford University, which may include:

• One-Time Passcodes (OTP): Verification messages to confirm your phone number during the application or enrollment process.

• Transactional messages: Application status updates, enrollment confirmations, billing reminders, and other program-related notifications.

• Marketing communications: Information about Nexford programs, services, events, and other relevant content, where explicit consent has been provided as required by law.

Message Frequency

Message frequency varies. OTP and transactional messages are typically triggered by your own actions (e.g., submitting an application). Additional messages may be sent as needed in connection with your application or enrollment.

Message & Data Rates

Message and data rates may apply. Any such charges are billed by your mobile carrier. Nexford University is not responsible for charges incurred from your mobile carrier in connection with SMS messages.

How to Opt Out

You may opt out of receiving SMS messages at any time by:

• Replying STOP to any SMS message received from us

• Contacting us at help@nexford.edu

Upon opting out, you will receive one final confirmation message. Opting out of marketing SMS does not affect the delivery of OTP or transactional messages necessary to complete your application or verify your account.

4.3 Phone / Voice Calls

By providing your mobile phone number and checking the consent checkbox through any University form, you agree that Nexford University may contact you via voice call for purposes including but not limited to: application follow-up, enrollment support, program advising, and marketing outreach.

You may opt out of receiving marketing voice calls at any time by:

• Requesting removal during any call with a Nexford representative

• Contacting us at help@nexford.edu

Opting out of marketing calls does not affect calls that are transactional or administrative in nature (e.g., enrollment confirmations or urgent account-related communications).

4.4 WhatsApp

By providing your mobile phone number and checking the consent checkbox through any University form, you agree that Nexford University may contact you via WhatsApp for purposes including application support, enrollment assistance, program information, and marketing communications.

WhatsApp communications from Nexford University are subject to WhatsApp's Terms of Service in addition to these Terms. Nexford University is not responsible for WhatsApp's data practices; please review WhatsApp's Privacy Policy for details.

4.5 Email

By providing your email address and checking the consent checkbox through any University form, you agree that Nexford University may contact you via email for purposes including application updates, enrollment information, program-related communications, and marketing outreach.

You may opt out of marketing emails at any time by:

• Clicking the unsubscribe link included in any marketing email

• Contacting us at help@nexford.edu

Opting out of marketing emails does not affect transactional or administrative emails necessary to support your application, enrollment, or ongoing studies.

5. Privacy & Data

5.1 Privacy Policy

The collection, use, protection, and disclosure of your personal information is governed by Nexford University's Privacy Policy, which is incorporated into these Terms by reference. By agreeing to these Terms, you also acknowledge that you have read and understood our Privacy Policy.

5.2 FERPA

Nexford University complies with the Family Educational Rights and Privacy Act (FERPA). Access to education records is limited to school officials with a legitimate educational interest, in accordance with 34 CFR §99.31. Learners have the right to access and request amendment of their records, and to consent to disclosures of personally identifiable information except where permitted by law. 5.3 GDPR

Nexford University complies with the European Union's General Data Protection Regulation (GDPR). Learners residing in the EU have the right to access, correct, erase, restrict, object to the processing of their personal data, and the right to data portability, subject to applicable conditions and limitations. 5.4 Data Retention

Personal information is retained only for as long as necessary to fulfill the purposes outlined in our Privacy Policy, or as required by law. When personal information is no longer needed, it is securely destroyed or permanently deleted.
